Громадська організація судових експертів «Всеукраїнська незалежна науково-дослідна експертна спілка» 26 липня 2026 року оприлюднила відкритий лист до Комісарки ЄС з питань розширення та східного сусідства Марти Кос та Представництву ЄС в Україні. Приводом стало те, що розгляд Урядом законопроєкту Міністерства юстиції «Про внесення змін до Закону України "Про судову експертизу" щодо уніфікації судово-експертної діяльності» зупинено до отримання позиції Європейської комісії — 9 червня Урядовий комітет повернув проєкт. Спільнота приватних судових експертів просить Комісію відобразити у своїй позиції системні застереження, кожне з яких у листі супроводжується посиланням на верифіковане джерело.
Реформа судово-експертної сфери є прямим завданням Дорожньої карти з питань верховенства права в межах переговорних розділів 23–24: єдиний орган формування політики, єдина класифікація експертиз, єдиний порядок їх проведення та розширення ролі експертів, які не працюють у державних установах. Орієнтовний строк виконання — другий квартал 2026 року — минув, і, жодного з цих результатів не досягнуто. Взагалі історично, початок масштабної судово-експертної реформи в Україні пов'язаний з Указом Президента України № 837/2019 від 8 листопада 2019 року «Про невідкладні заходи з проведення реформ та зміцнення держави». Цей документ дав поштовх до перетворення сфери судової експертизи та зміцнення суміжних правових інститутів - наводиться для розуміння історії питання та процесу його гальмування в державі і досі коли ведеться війна, а приорітети на користь людей владою не змінюються.

Вельмишановна пані Комісарко!
Звертаємося до Вас як представники спільноти приватних судових експертів України в момент, коли розгляд урядом законопроєкту Міністерства юстиції про «уніфікацію» судово-експертної діяльності зупинено до отримання позиції Європейської комісії (рішення Урядового комітету від 9 червня про повернення проєкту). Просимо врахувати викладені нижче застереження, кожне з яких підтверджується верифікованими джерелами.
1. Реформа гальмується роками, а строк, визначений зобов'язаннями самої України, сплив.
Реформа судово-експертної сфери — пряме завдання Дорожньої карти з питань верховенства права в межах переговорних розділів 23–24 (єдиний орган формування політики, єдина класифікація експертиз, єдиний порядок їх проведення, розширення ролі експертів, які не є працівниками державних установ) з орієнтовним строком виконання до другого кварталу 2026 року. Цей строк минув, жоден із результатів не досягнутий. Незалежне дослідження Проєкту ЄС «Право-Justice» (автор — Павел Рибіцький, ексголова ENFSI), завершене восени 2024 року й оприлюднене в липні 2025-го, поставило системі діагноз, який повністю зберігає актуальність: вкрай фрагментована система без цілісної архітектури, десятки публічних надавачів із дублюванням компетенцій, сім конкурентів лише всередині Мін'юсту, приватний сектор скорочено до 400–500 реально практикуючих експертів. Жодну з 25 стратегічних рекомендацій дослідження не впроваджено; центральну — позавідомчий Орган з питань судової науки та судової експертизи, підзвітний Парламенту, — відкинуто на користь протилежної моделі.
2. Законопроєкт закріплює саме ті вади, які європейська рамка покликана усунути.
Наш детальний правовий аналіз показує: у законопроєкті немає жодного положення про акредитацію за ISO/IEC 17025 чи ISO/IEC 17020, валідацію методів, професійне тестування або мінімальні критерії компетентності персоналу — елементи, що становлять ядро європейської моделі взаємної довіри за Рамковим рішенням Ради 2009/905/ЮВС та висновками Ради ЄС 2011 і 2016 років щодо Європейського простору судової науки. Натомість проєкт концентрує в Мін'юсті несумісні функції формування політики, регулятора, контролера приватних експертів та управителя найбільшої мережі державних надавачів; переносить визначення меж державної монополії на експертизи із закону у відомчий акт без законодавчих критеріїв; зберігає підпорядкованість експертних установ органам досудового розслідування, включно зі Службою безпеки; створює підконтрольну виконавчій владі «пріоритетну» установу для експертиз у провадженнях щодо посадових осіб. Останнє прямо суперечить рекомендації Звіту Комісії щодо України 2025 року про доступ НАБУ до незалежних експертиз та пріоритету № 2 Спільної заяви від 11 грудня 2025 року щодо забезпечення НАБУ ефективного доступу до безсторонніх, своєчасних і високоякісних судових експертиз.
3. Законопроєкт готувався без публічних консультацій — цей факт нами перевірено.
26 липня 2026 року ми розділ за розділом перевірили офіційні консультаційні сторінки сайту Міністерства юстиції (повний перелік електронних консультацій з громадськістю за травень 2024 – липень 2026 та перелік публічних громадських обговорень проєктів актів). Законопроєкт про уніфікацію судово-експертної діяльності там ніколи не оприлюднювався; ба більше, за весь цей період на консультації не виносився жоден проєкт акта щодо судової експертизи. Консультації з професійною спільнотою міністерство анонсувало лише після подання проєкту до Кабінету Міністрів — усупереч принципам залучення заінтересованих сторін, закріпленим у настановах Better Regulation самої Комісії. Спільнота приватних судових експертів, чиї права проєкт зачіпає безпосередньо, не мала можливості бути почутою на етапі розробки.
4. Ціна бездіяльності найвища там, де Україна найменше може собі її дозволити: розслідування воєнних злочинів.
В Україні досі немає дієвого механізму залучення іноземних надавачів судово-експертних послуг чи іноземних фахівців як незалежних судових експертів у національних кримінальних провадженнях: за статтею 23 Закону «Про судову експертизу» іноземні фахівці можуть лише в окремих випадках включатися до спільних експертних комісій під керівництвом державних установ. Дослідження «Право-Justice» прямо рекомендувало запровадити регулювання, що уможливить призначення іноземних надавачів або приватних практиків незалежними судовими експертами, окремо наголосивши: розслідування воєнних злочинів, які мають витримати міжнародну перевірку, особливо виграють від об'єктивності та спроможності, які дає таке залучення. Законопроєкт цю рекомендацію повністю ігнорує. В умовах війни, коли національні лабораторії перевантажені, а кожна десята експертиза, за даними самого міністерства, стосується наслідків війни, відсутність цього механізму — не технічна прогалина, а системна вразливість відповідальності за найтяжчі міжнародні злочини.
5. Наші прохання.
Перше: щоб позиція Комісії щодо законопроєкту відобразила, що «уніфікація» в поточній редакції є адміністративною централізацією, а не гармонізацією якості, і щоб підтримка проєкту була обумовлена архітектурними змінами — законодавчою рамкою поетапної акредитації за ISO/IEC 17025 та ISO/IEC 17020 через національний орган з акредитації; розмежуванням функцій формування політики, регулювання і надання послуг; законодавчими критеріями будь-якої виключної компетенції державних установ; гарантіями ефективного доступу НАБУ і сторони захисту до інституційно незалежних експертиз відповідно до пріоритету № 2 Спільної заяви; механізмом призначення іноземних надавачів і фахівців незалежними судовими експертами з першочерговим застосуванням у провадженнях щодо воєнних злочинів.
Друге: щоб Комісія заохотила Уряд України провести справжні публічні консультації щодо проєкту за участю приватних судових експертів до його повторного подання та оприлюднити таблицю узгодження із зауваженнями Комісії. Третє: щоб виконання судово-експертних завдань Дорожньої карти моніторилося за вимірюваними індикаторами, а не за самим фактом ухвалення закону.
Залишаємося в розпорядженні Комісії, її служб та Представництва ЄС в Україні для надання аналітичних матеріалів, документів і практичних доказів, згаданих у цьому листі. З повагою, приватні судові експерти України.

Subject: The stalled reform of the forensic science and judicial expertise system in Ukraine — request to reflect systemic concerns in the Commission's position on the draft law “On Amendments to the Law of Ukraine 'On Forensic Examination' concerning the Unification of Forensic Expert Activity”
Dear Commissioner,
We write to you as representatives of the community of private judicial experts of Ukraine, at the moment when the Cabinet of Ministers of Ukraine has suspended consideration of the Ministry of Justice's draft law on the “unification” of forensic expert activity pending the position of the European Commission (decision of the Governmental Committee of 9 June returning the draft). We respectfully ask that the concerns set out below, each of which is supported by verifiable sources, be taken into account when that position is formulated.
1. The reform has been stalled for years, and the deadline set by Ukraine's own commitments has passed
Reform of the forensic sector is an explicit task of Ukraine's Rule of Law Roadmap adopted in the context of accession negotiations under Chapters 23–24 (a single policy-making body, a unified classification of examinations, a unified procedure, and expansion of the role of experts who are not employees of state institutions), with an indicative implementation deadline of the second quarter of 2026. That deadline has passed without any of these outcomes being delivered. The independent study commissioned by the EU Project Pravo-Justice (author: Paweł Rybicki, former Chair of ENFSI), completed in autumn 2024 and published in July 2025, diagnosed the system in terms that remain fully valid today: it is “highly fragmented and does not form a coherent set-up”, dozens of publicly funded providers overlap in competence and geography, seven providers compete within the Ministry of Justice alone, and the private expert sector has been reduced to 400–500 actively practising experts. None of the study's 25 strategic recommendations has been implemented; its central recommendation — a non-ministerial Forensic Science and Judicial Expertise Authority reporting to Parliament — has been disregarded in favour of the opposite model.
2. The pending draft law entrenches the very defects the EU framework is designed to eliminate
Our detailed legal analysis of the draft law shows that it contains no provisions whatsoever on accreditation to ISO/IEC 17025 or ISO/IEC 17020, on validation of methods, proficiency testing or minimum competence criteria for personnel — the elements that constitute the core of the European model of mutual trust under Council Framework Decision 2009/905/JHA and the Council conclusions of 13–14 December 2011 and 9 June 2016 on the European Forensic Science Area. Instead, the draft concentrates in the Ministry of Justice the incompatible functions of policy-maker, regulator, controller of private experts and administrator of the largest network of state providers; it transfers the definition of the boundaries of the state monopoly on examinations from the level of law to a ministerial act without any statutory criteria; it retains the departmental subordination of expert institutions to bodies conducting pre-trial investigation, including the Security Service; and it establishes a “priority” research institution, controlled by the executive, for examinations in criminal proceedings concerning public officials. The last element directly conflicts with the recommendation of the Commission's Ukraine Report 2025 to grant NABU access to independent forensic examinations and with Priority No. 2 of the Joint Statement of 11 December 2025: “Ensure that NABU has effective access to impartial, timely and high-quality forensic examinations.”
3. The draft was prepared without public consultation — a fact we have verified
On 26 July 2026 we verified, section by section, the official consultation pages of the Ministry of Justice website (the complete list of electronic public consultations for May 2024 – July 2026 and the list of public discussions of draft legal acts). The draft law on unification of forensic expert activity has never been published there; indeed, over that entire period not a single draft act concerning forensic examination was submitted for public consultation. Consultations with the professional community were announced by the Ministry only after the draft had already been submitted to the Cabinet of Ministers — an approach contrary to the stakeholder-engagement principles of the Commission's own Better Regulation Guidelines. The community of private judicial experts, whose rights and professional activity the draft directly affects, was given no opportunity to be heard at the drafting stage.
4. The cost of inaction is highest where Ukraine can least afford it: war crimes investigations
Ukraine currently has no workable mechanism for engaging foreign forensic science providers or foreign practitioners as independent judicial experts in domestic criminal proceedings: under Article 23 of the Law “On Forensic Examination”, foreign specialists may only, in certain cases, be included in joint expert commissions led by state institutions. The Pravo-Justice study explicitly recommended introducing regulations enabling the appointment of foreign providers or private practitioners as independent judicial experts, noting that war crimes investigations — which must withstand international scrutiny — would particularly benefit from the objectivity and capacity such appointments provide. The pending draft law ignores this recommendation entirely. In wartime conditions, with domestic laboratories overloaded and every tenth examination already related to the consequences of the war (according to the Ministry's own reporting), the absence of this mechanism is not a technical omission but a systemic vulnerability of accountability for the gravest international crimes.
5. What we respectfully request
First, that the Commission's position on the draft law reflect that “unification” as currently drafted amounts to administrative centralisation rather than harmonisation of quality, and that support for the draft be conditioned on architectural changes: a statutory framework for phased accreditation to ISO/IEC 17025 and ISO/IEC 17020 through the national accreditation body; separation of policy-making, regulation and service provision; statutory criteria for any exclusive competence of state institutions; guarantees of effective access of NABU and of the defence to institutionally independent examinations, in line with Priority No. 2 of the Joint Statement; and a mechanism for appointing foreign providers and practitioners as independent judicial experts, with priority application to war crimes proceedings.
Second, that the Commission encourage the Government of Ukraine to conduct genuine public consultations on the draft, with the participation of private judicial experts, before its resubmission, and to publish a table of concordance with the Commission's observations. Third, that the implementation of the forensic tasks of the Rule of Law Roadmap be monitored against measurable indicators rather than the mere fact of adoption of a law.
We remain at your disposal, and at the disposal of the Commission's services and of the EU Delegation to Ukraine, to provide the underlying analyses, documents and practical evidence referred to in this letter. Respectfully, forensic experts who are not employees of Ukraine's state-run specialized institutions.
